THE LIFESTYLE CHANNEL’S “GRAND DESIGNS AUSTRALIA LIVE” COMPETITION
TERMS AND CONDITIONS 
(“TERMS AND CONDITIONS”)

ENTRY INTO THE COMPETITION

1.	Entry into the LifeStyle Channel’s “Grand Designs Australia Live” competition (the “Competition”) is open to all residents of Australia 18 years or over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”).  Information on how to enter forms part of the terms of entry.  Entry into the Competition is deemed acceptance of these Terms and Conditions.

2.	The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, Foxtel, Optus TV, Telstra and their related bodies corporate are not eligible to enter.

3.	Competition begins at 00.01 (AEST) on Monday 23 July 2012 and closes at 23:59 (AEST) on Tuesday 21 August 2012 (the “Competition Period”).

4.	To enter the Competition and be eligible to win, entrants must:

a)	be over 18 years of age; 
b)	register for membership online at www.lifestyle.com.au;
c)	complete the online entry form; and 
d)	in 25 words or less answer the following question ”What is your best renovating tip and why?” (the “Competition Question”).

6.	All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth.  All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringes the intellectual property rights of any third party, contains any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.

7.	Only one entry per household is permitted for this Competition. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.

PRIZE

8.	There is one (1) prize to be won in total, valued at a maximum of $2,500.00. The Prize winner may nominate to take the Sydney prize or the Melbourne prize (each referred to as the “Prize”).

The Sydney prize consists of the following:

•	return economy flights from the capital city airport in Australia nearest to the Prize winner’s place of residence to Sydney (departing on Friday 5 October 2012 and returning on Sunday 7 October 2012) for the Prize winner and one guest; and
•	two (2) nights’ twin-share accommodation in a 4 star hotel in Sydney (check-in on Friday 5 October 2012 and check-out on Sunday 7 October 2012) (the “Hotel”);
•	return airport transfers between Sydney domestic airport and the Hotel for the Prize winner and their guest OR in the event that the Prize winner resides within 80 kms from Sydney CBD, return transfers between the Prize winner’s place of residence and the Hotel; and
•	two tickets to ‘Grand Designs Australia’ live show in Sydney (the ‘Show’); and 
•	the opportunity to participate in a 10 minute group ‘meet and greet’ with Peter Maddison at the Show.

The Melbourne prize consists of the following:

•	return economy flights from the capital city airport in Australia nearest to the Prize winner’s place of residence to Melbourne (departing on Friday 21 September 2012 and returning on Sunday 23 September 2012); and
•	two (2) nights’ twin-share accommodation in a 4 star hotel in Melbourne (check-in on Friday 21 September 2012 and check-out on Sunday 23 September 2012) (the ‘Hotel’); and
•	return airport transfers between Melbourne domestic airport and the Hotel for the Prize winner and their guest OR in the event that the Prize winner resides within 80 kms from Melbourne CBD, return transfers between the Prize winner’s place of residence and the Hotel; and
•	two tickets to ‘Grand Designs Australia’ live show in Melbourne (the ‘Show’); and 
•	the opportunity to participate in a 10 minute group ‘meet and greet’ with either Kevin McCloud or Peter Maddison at the Show (to be determined in the sole discretion of the supplier).

9.	The total maximum Prize pool value is up to$2,500.00. The Prize value is the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.  All Prize values are in Australian dollars.

10.	All aspects of the Prize must be taken together as a package. If the Prize winner does not take the Prize on the dates stipulated in clause 8, the Prize will be forfeited and a substitute prize will not be offered in lieu of it under any circumstances.

11.	It is a condition of accepting the prize that the winner must comply with any conditions of use of the Prize and the Prize supplier’s requirements.

12.	The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes.

13.	If the Prize (or any part of the Prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no other liability or responsibility for any loss incurred by the Winner or any other party if the Prize (or any part of the Prize) is unavailable for any reason.

14.	 The Prize may be transferred at the Promoter’s sole discretion. In the event that the Promoter exercises its discretion to allow the Prize winner to transfer the Prize, the transfer will be on the condition that the transferee accepts all terms and conditions set out in these Terms and Conditions and the Promoter may require such acceptance in writing at its absolute discretion.
 
15.	Once the Prize has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.

JUDGING AND AWARD OF PRIZE

16.	The Competition will be judged on the basis of originality and creativity by the Promoter at Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on the Wednesday 22 August 2012. Chance plays no part in the selection of the Prize winner. The Prize winner will be notified by phone on Thursday 23 August 2012 and their names published on the LifeStyle Channel website from Friday 24 August 2012. The Prize must be claimed within 7 days of the publication of the Prize winner’s name.

17.	If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

18.	In the event that a Prize remains unclaimed 7 days after the publication of the Prize winner’s names on the LifeStyle Channel website, an unclaimed prize determination will be conducted by the Promoter and will take place at Level 1, 5 Thomas Holt Drive, North Ryde, NSW, 2113 on Friday 31 August at 12:00 (AEST). The winner of the unclaimed prize determination will be notified via phone on Friday 31 August 2012 and their name will be published on the Lifestyle Channel website on the same date.

TRAVEL

19.	It is a condition of entry that the Prize winner and their guest must be available and able to travel to and stay in Sydney or Melbourne on the dates period specified by the Promoter in clause 8.

20.	It is the sole responsibility of the Prize winner and his/her guest to ensure that their personal documentation (including but not limited to passports, visas etc) is valid. Any expenditure incurred as a result of not meeting such requirements is the sole responsibility of the Prize winner and his/her guest. Travel insurance is advisable for the Prize winner and his/her guest, though all such arrangements are the sole responsibility of the Prize winner and his/her guest.

21.	In the event that the nearest capital city airport in Australia to the Prize winner’s place of residence is Sydney or Melbourne, (which shall be determined in the absolute discretion of the Promoter), the flight components of the Prize will be forfeited in full and no substitute will be offered. Alternatively, if the Prize winner elects to arrange their own private transport to the Sydney or Melbourne Hotel from his/her place of residence in Sydney or Melbourne, the flights and the transfer components of the Prize will be forfeited in full and no substitute will be offered. The Prize winner and his/her guest will be solely responsible for the arrangements of, and, all costs associated with any such alternative transport.

22.	All ancillary costs incurred in taking and using the Prize (including but not limited to transfers to and from the airport in the Prize Winner’s capital city from his/her place of residence, meals (other than those indicated in the Prize description), mini bar, spending money, insurance and taxes) are the responsibility of the Prize winner and his/her guest.

23.	 A credit card imprint or cash deposit may be required from the Prize winner and/or his/her guest at check-in to the Hotel, for all incidental charges

24.	All Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

25.	Frequent Flyer points are not available for any of the flights included in the Prize.

26.	Airline tickets included in the Prize cannot be used as part-payment of another airfare.

27.	The Prize winner and his/her guest must depart from and return to the same point of departure and travel together being the capital city airport nearest to the Prize winner’s place of residence.

GENERAL
							
28.	All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered.

29.	By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect.

30.	No responsibility will be taken by the Promoter, The LifeStyle Channel, Foxtel, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.

31.	The Promoter reserves the right, in its absolute discretion, to disqualify:
a)	any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b)	any individual who tampers with the entry process, submits an entry that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.

32.	The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prize to cancel or vary the Competition or to vary or cancel the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a)	the Prize winner does not satisfy the Competition entry requirements; or 
b)	the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
33.	In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize it shall not:
a)	be liable to any person for any costs, loss or damage (including costs, loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b)	be required to conduct the Competition at any other time.
34.	No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

35.	A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

36.	Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or sickness suffered or sustained as a result of accepting or using the Prize or entering the Competition.

37.	The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.

38.	By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.lifestyle.com.au  for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.

39.	Entrants are advised that “opt-in” entries will be entered into a database and the Promoter may use the entrant’s personal information for future promotional, marketing and publicity purposes in any media worldwide and without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose.
