TERMS OF PARTICIPATION – ‘HOME’ YOU TRY IT, YOU RATE IT PROMOTION

•	Registration for the “You Try it, You Rate it” promotion (“the Promotion”) is open to all residents of Australia except ACT residents. The Promoter is XYZnetworks Pty Limited (ABN 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). These Terms of Participation form part of the conditions of entry. Entry into the Promotion is deemed acceptance of these Terms of Participation.

•	The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with the Promotion, FOXTEL or AUSTAR and their related bodies corporate are not eligible to enter.

•	The Promotion begins at 12:01 am (AEDT) on 17/08/12 and closes at 11.59pm (AEDT) on 23/08/12 (the “Promotion Period”).

A pre-determined number of people who have registered for the Promotion will be randomly selected to review 1 x Window film installation valued at $1000 (NSW Metro home owners only) (“Product”), subject to meeting the requirements under these Terms of Participation (“HOME Reviewer”). The HOME Reviewers will be randomly selected by Red Promotions ABN: 18 204 124 053 of 8/63 Bream St, Coogee, NSW, 2034. By entering the Promotion, participants agree to have their personal information passed onto Red Promotions for the purpose of selecting the HOME Reviewers. The Promoter accepts no responsibility for any other use of the HOME Reviewers’ personal information by Red Promotions.

•	To become a HOME Reviewer, participants must:

(a)	Register online at www.lifestylehome.com.au;
(b)	Become a member of LifeStyle HOME;
(c)	Fulfil the age or other criteria specified for the Product; and
(d)	If chosen as a HOME Reviewer, complete a written review of the Product (“Product Review”).

Participants who become a member of LifeStyle HOME will have the choice to receive promotional material from the Promoter including, but not limited to, electronic newsletters. Participants can unsubscribe from receiving the promotional materials from the Promoter at any time by following the unsubscribe prompts.

Participants who enter the Promotion also agree that if they are selected as HOME Reviewers, their personal information and Product Reviews will be passed onto a third party supplier of the Product for the purpose of that third party supplier distributing the Product to the HOME Reviewers. The Promoter accepts no responsibility for any other use of the HOME Reviewers’ personal information by the third party supplier.

•	All entries must include the entrant’s name, residential address (PO boxes will not be accepted), postcode, daytime phone number (including area code), mobile phone number, email address and date of birth to be eligible for the Promotion. Incomplete entries will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address or contact number changes during the Promotion Period.

The total maximum value of the Promotion is $1000 (including 1 x Window film installation valued at $1000 (NSW Metro home owners only)). The Product value is the recommended retail value as provided by the supplier and is correct at the time of printing on the LifeStyle HOME website. The Promoter is neither responsible nor liable for any change in the value of the Product occurring between publishing date and the date the Product is distributed.
•	The Product is not transferable or redeemable for cash. The Product cannot be exchanged for any other Product. The contents of the Product will be at the Promoter’s sole discretion. The Product is subject to availability and the terms and conditions of the entity supplying the Product. In the event that the Product becomes unavailable, for whatever reason, the Promoter reserves the right not to substitute the Product for an alternative Product/s.

•	Those participants who are selected to be a HOME Reviewer will be notified by an electronic card (ecard) sent to the HOME Reviewer’s email address at or around 5.00pm (AEDT) on 24/08/12.

•	Following notification by the Promoter (or the Promoter’s agent) that an entrant has been selected as a HOME Reviewer, the supplier will endeavour to send the Product to the HOME Reviewer at the HOME Reviewer’s nominated residential address within 21 days, subject to any special provisions relating to the Product.  If a selected HOME Reviewer cannot be contacted or the Promoter is unable to deliver the Product to the HOME Reviewer, then the Product will not be offered to the HOME Reviewer for the purposes of a Product Review.

•	It is a condition of accepting the Product to review that the HOME Reviewer must comply with all the conditions of use of the Product and Product supplier’s requirements. The Product must be taken as stated and no compensation will be payable if a HOME Reviewer is unable to use the Product as stated.

•	HOME Reviewers must submit a valid review to the LifeStyle HOME website via the link provided on the confirmation ecard or by following the links on the LifeStyle HOME website within 21 days of receiving the Product in order to be eligible to review any future products. HOME Reviewers who do not satisfy review requirements by the stipulated date will be removed from the validated reviewing list immediately. No responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements that may prevent the HOME Reviewers from reviewing the Product.

•	The Promoter, or the Promoter’s agent, will select a maximum of three Product Reviews for the Product (at its sole discretion) which will be published on the LifeStyle HOME website and otherwise communicated to the public in any media by the Promoter. Any Product Review which contains defamatory, offensive, pre-used or copyrighted material will be ineligible for publication and those HOME Reviewers will be removed from the validated reviewing list immediately.

•	By submitting a Product Review, each HOME Reviewer warrants that their entry is their own original work, and that they own all rights, including copyright, in their entry. Each HOME Reviewer indemnifies the Promoter in the event that this warranty is false.

•	HOME Reviewers acknowledge that all entries and all Product Reviews become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes in any media at any time. By entering the Promotion, HOME Reviewers agree to the use of their name, Product Review, image and/or photograph without compensation and agree that the Promoter will own copyright in any such images, Product Reviews and/or photographs.

•	Some Products may require an element of travel, for example if a HOME Reviewer is required to do a Product Review for a spa treatment. All ancillary costs incurred in taking and using such Products (including, but not limited to, travel and meals) are the responsibility of the HOME Reviewer, unless expressly stated as being part of the Product.

•	Participants who are under 18 years of age are required to check the description of the Product on the Lifestyle HOME website (www.lifestylehome.com.au) for details of any age restrictions which may apply to particular the Product. Entries received from participants who are under the age of 18 where the Product does have age restrictions will be ineligible to be a HOME Reviewer.

•	All participants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a HOME Reviewer or if reasonably requested by the Promoter or the Promoter’s authorised agent. In the event that a HOME Reviewer cannot provide suitable proof, the HOME Reviewer will forfeit the chance to receive the Product and/or provide a Product Review.

•	No responsibility will be taken by the Promoter, LifeStyle HOME, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that my prevent a participant from becoming a HOME Reviewer.

•	It is a condition of entering the Promotion that those participants selected to be HOME Reviewers may required to sign a legal release in a form determined by the Promoter in its absolute discretion.

•	The Promoter reserves the right, in its absolute discretion, at any time during the Promotion, to cancel or vary the terms of the Promotion or the contents of the Product, including without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

(a)	a participant/HOME Reviewer does not satisfy the Promotion entry requirements; or
(b)	the Promoter cannot conduct the Promotion for any reason beyond its control.

•	In the event that the Promoter cancels or varies the Promotion, it shall not:

(a)	be liable to any person for any loss or damage (including loss or damage caused by negligence) arising out of, or in connection with such cancellation, variation or withdrawal; and
(b)	be required to conduct the Promotion at any other time.

•	Any decision by the Promoter in relation to the conduct of the Promotion is binding and conclusive and no correspondence will be entered into.

•	Participants enter the Promotion at their sole risk. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss or personal injury suffered or sustained by any participant and/or HOME Reviewer during the course of the Promotion or in connection with any use of the Product.

•	HOME Reviewers agree to release and hold harmless the Promoter and its subsidiaries and affiliates, and each of their respective parent companies and each such company's officers, directors, shareholders, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of use of the Product as part of this Promotion.
