MODERN FISHING/LIFESTYLE "CATCH OF THE WEEK" COMPETITION TERMS AND CONDITIONS

ENTRY INTO THE COMPETITION

1.	Entry into the Modern Fishing/LifeStyle "Catch of the Week" competition (the "Competition") is open to all residents of Australia. The Promoter is News Limited Pty Ltd (ABN 57 088 923 906) of 180 Bourke Road, Alexandria NSW 2015 (the "Promoter").  Information on how to enter forms part of the terms of entry.  Entry into the Competition is deemed acceptance of these terms and conditions.

2.	The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, XYXnetworks Pty Limited ("XYZ"), FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.

3.	Competition begins at 00.01 (AEST) on Wednesday July 7 2010 and closes at 23:59 (AEDT) on Wednesday November 24 2010 (the "Competition Period").

4.	To enter the Competition and be eligible to win, entrants must

a)	Log onto www.lifestylechannel.com.au/fishing and complete the entry form including uploading a recent photo of yourself and your catch;

b)	Send your full name, address and daytime contact number along with a copy of your photo to: Modern Fishing Competition, Locked bag 5030, Alexandria NSW 2015.

5.	All entries must include the entrant's name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable) and email address to be eligible for entry. Incomplete entries or those with defamatory, pre-used, copyrighted or offensive content will be ineligible. It is the entrants' responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period.

6.	Multiple entries are accepted during the Competition Period, however each entry must be unique and submitted as a separate entry .The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited ("Repeat Entry Device"). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.

7.	There are 27 prizes in total.  Each prize consists of:

a.	Daiwa Fishing Reel - $199.95
b.	Daiwa Hat - $19.95
c.	Daiwa Key ring - $4.95
d.	Daiwa Sticker - $3.95
e.	Daiwa Lanyard - $1.95
f.	Daiwa Pen - $1.95
g.	Modern Fishing Magazine's latest issue - $7.95
h.	Lure courtesy of modern fishing - $9.95
i.	One pair of Mako sunglasses - $179.95

Total Value of each prize $430.55

8.	The prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter's sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes.

9.	The total maximum Prize pool value is $10,005.30 (i.e. 9 x Prizes valued at $250.60 each from 7 July 2010 to 7 September 2010 + 18 x Prizes valued at $430.55 each from 8 September to 24 November 2010). The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter and XYZ are neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.  All Prize values are in Australian dollars.

10.	Only one Prize per person will be awarded.

JUDGING AND AWARD OF PRIZE

11.	The Competition will be judged on the basis of creativity and the superior quality of your photo and fish at News Magazines, 180 Bourke Road, Alexandria NSW 2015 each Wednesday at 2.00pm (AEST), commencing on Wednesday July 14 2010.

12.	Weekly judging will take place every Wednesday at 2pm for entries received Monday till Sunday from the previous week. Entries will be judged at News Magazines 180 Bourke Road, Alexandria, NSW 2015. The last date entries will be judged is Wednesday 24th November 2010.

13.	Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email or phone within two days following each week's prize draw, and their names published on the LifeStyle Channel website and monthly in the Modern Fishing Magazine. The Prize must be claimed within 7 days of the publication of the Prize winner.

14.	If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

GENERAL

15.	By entering the Competition, each entrant warrants that:
a)	their entry is their own original work;
b)	they own all rights in the image submitted; and
c)	the Promoter's or XYZ's use of the image will not infringe the rights of any third person

16.	All entrants agree to provide the Promoter or the Promoter's authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner/s or if reasonably requested by the Promoter or the Promoter's authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.

17.	The name and photograph of the winner may be used for promotional purposes by the Promoter and XYZ, unless the winner otherwise notifies the Promoter and XYZ at the time of accepting the prize.

18.	The winner agrees to participate in any news media activities surrounding the promotion such as photographic shoots and interviews. The winner agrees to have their catch photo and their details on the Lifestyle Channel website and in on air promos.

19.	No responsibility will be taken by the Promoter, XYZ, LifeStyle Channel, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.

20.	The Promoter and XYZ reserves the right, in their absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter's opinion (which it shall form in its absolute discretion):
(a) a Prize winner does not satisfy the Competition entry requirements; or 
(b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.

21.	In the event that the Promoter or XYZ cancels or varies the Competition or varies or withdraws the Prizes they shall not:
 
(a)	be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
(b)	be required to conduct the Competition at any other time.

22.	No responsibility will be accepted by the Promoter or XYZ for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter's database and NOT time of transmission by the entrant. The Promoter and XYZ will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter and XYZ accept no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

23.	In the event of a promoter other than News Magazines cancelling any event related to this Prize, News Magazines and XYZ cannot be held responsible.

24.	The Promoter and XYZ accept no responsibility for any Prizes that are damaged, delayed or lost in transit.

25.	The Promoter and XYZ reserve the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter or XYZ, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.

26.	Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation.

27.	A decision of the Promoter or XYZ in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

28.	Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter and XYZ shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.

29.	The Promoter collects your information to include you in this competition and will disclose the information to others who help us run the competition. The Promoter may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. The Promoter may share your information with other persons or entities that assist us in performing the above or with another company which provides prizes for the competition. 30.	All entries, including photographs, become the property of the Promoter and XYZ and may be communicated to the public, or other media by the Promoter and XYZ or used for promotional purposes, subject to the Promoter's and XYZ's privacy policies which are available at www.modernfishing.com.au/index.php?footer=privacy and http://www.lifestylefood.com.au/about/privacypolicy.asp. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation.
